1.  Validity of general terms and conditions<\/strong><\/h2>\n

1.1 The general terms and conditions apply between the customers of www.sailing.ee (hereinafter referred to as the Customer) and the owner of www.sailing.ee:<\/p>\n

(hereinafter www.sailing.ee) on the legal relations arising from the purchase of goods.<\/p>\n

1.2 The general terms and conditions cannot be in conflict with the national rules in force in the Republic of Estonia and they are, where necessary (in case of disputes or missing information), supplemented by such rules.<\/p>\n

1.3 www.sailing.ee reserves the right to unilaterally modify these terms and conditions as well as the service prices for the purposes of efficiency, competitiveness, future development and to supplement or reorganise the range of services. Changes and additions to service  prices enter into force as from the date of publication of this information on www.sailing.ee. If the Customer submitted their order before the amendment to the terms and conditions entered into force, the Customer is subject to the terms and conditions in force at the time of placing the order, unless otherwise provided by law or these terms and conditions.<\/p>\n

1.4 www.sailing.ee and the Customer wish to trade through the www.sailing.ee website on the terms and conditions set out in this document. By placing an order on www.sailing.ee and making a payment at , the Customer confirms that they have read and agree to the sales terms and conditions.<\/p>\n

2.  www.sailing.ee price list<\/strong><\/h2>\n

2.1 The prices of the products sold on the www.sailing.ee  website are given in euros excluding delivery costs  (except in the case of promotions)<\/p>\n

2.2 All prices on the e-shop of www.sailing.ee are inclusive of 0% VAT.<\/p>\n

2.3 www.sailing.ee reserves the right to adjust prices. If the Customer had placed the order before the price change entered into force, the applicable price shall be the one that was quoted in the order confirmation when the order was placed.<\/p>\n

2.4 For more information on delivery methods and prices, see the \u201cTransport\u201d section.<\/p>\n

3.  Shopping Cart and completing purchases<\/strong><\/h2>\n

3.1 The Customer\u2019s Shopping Cart is created the moment they click on the \u201cAdd to cart\u201d button.<\/p>\n

3.2 Adding a product to the Shopping Cart does not commit the Customer to a purchase.<\/p>\n

3.3 The Customer can change the quantity of products in the Shopping Cart and, if necessary, remove them.<\/p>\n

3.4 The products in the Shopping Cart are available to other Customers until the order is confirmed.<\/p>\n

3.5 To complete the order, the Customer clicks on the \u201cComplete purchase\u201d button.<\/p>\n

3.6 When placing an order, the Customer chooses their preferred delivery method. The accuracy of the contact details provided in the order will determine whether the products purchased by the Customer will be delivered without problems and whether any additional costs will be incurred.<\/p>\n

3.7 You can pay for goods instantly via bank links.<\/p>\n

3.8 After clicking on the \u201cPlace order\u201d button, an order confirmation will be automatically sent to the Customer\u2019s email address.<\/p>\n

4.  Payment for the service ordered and delivery of the voucher<\/strong><\/h2>\n

4.1 The Customer can pay via bank links.<\/p>\n

4.2 A voucher with a QR code confirming the Customer\u2019s purchase is automatically sent to their e-mail address from the moment they have paid for their purchase. You don\u2019t need to print out the voucher separately, you can present it from your phone or tablet.<\/p>\n

5.  Cancellation of orders <\/strong><\/h2>\n

5.1 The Customer has the right to withdraw from the service after making a transfer for the ordered service  by sending an e-mail to  info@sailing.ee<\/a>  with a statement to that effect. The payment for the cancelled order will be refunded to the Customer\u2019s bank account as soon as possible, but no later than 14 days after the request has been submitted.<\/p>\n

5.2 Cancellation policy: if you cancel the service 30 days in advance (before the date of use of the service) we will refund 100% of the service price, if you cancel 14\u201329 days in advance we will refund 50%, if you cancel less than 14 days in advance no refund will be given. In case of a storm (consistent wind speeds over 15 m\/s) we will refund 100% of the advance payment.<\/p>\n

6. Right to lodge a complaint <\/strong><\/h2>\n

6.1. When the offered service is found to be defective, the Customer is required to send an e-mail to  info@sailing.ee<\/a>  with the following information:<\/p>\n

6.3.1. Customer\u2019s name and contact details;<\/p>\n

6.3.2. the date of lodging the complaint;<\/p>\n

6.3.3. shortcomings encountered in the use of the service<\/p>\n

6.3.4. claim against Vivasailing Purjetamiskool O\u00dc;<\/p>\n

6.3.5. the prepayment document or invoice number, if possible, attach a copy of this document.<\/p>\n

6.4. The application must be sent no later than 2 months after using the service. In the event of failure to comply with this time limit without good cause, the Customer loses the right to claim compensation for the service from www.sailing.ee <\/p>\n

6.5.  www.sailing.ee not responsible:<\/p>\n

6.5.1. For non-use of the service at the date of the reservation due to the fault of the Customer<\/p>\n

7. Liability and force majeure<\/strong><\/h2>\n

7.1. www.sailing.ee  is liable to the Customer for any damage  caused by the former due to a breach of these sales terms and conditions in the instances and to the extent stipulated in the current legislation of the Republic of Estonia.<\/p>\n

7.2. The Customer is liable to www.sailing.ee  for any damage caused by the former due to a breach of these sales terms and conditions in the instances and to the extent stipulated in the current legislation of the Republic of Estonia.<\/p>\n

7.3. Neither party is liable to the other party nor is their behaviour deemed a breach of these sales terms and conditions due to delayed performance of any obligation or failure to provide any obligation if the delay or failure to provide the obligation was caused by circumstances beyond the control of that party (force majeure).<\/p>\n

8. Other terms and conditions<\/strong><\/h2>\n

8.1. www.sailing.ee  Sailing uses the personal data provided by the Customer only to fulfill the Customer\u2019s purchase order. www.sailing.ee  shall not disclose any information it receives in the course of order fulfilment to third parties, except  as required by law.<\/p>\n

8.2. www.sailing.ee  reserves the right to send the Customer information about new services and promotional offers if the Customer has subscribed to the www.sailing.ee  newsletter. You have the right to request the deletion of your data from the www.sailing.ee  database.<\/p>\n

8.3. The Customer and www.sailing.ee  shall settle any issues not covered in these sales terms and conditions on the basis of the current legislation of the Republic of Estonia and other legal instruments that regulate the parties\u2019 relations.<\/p>\n

8.4. The parties shall strive to settle any disagreements and disputes derived from these sales terms and conditions primarily via negotiations. If such disputes cannot be settled via negotiations, both the Customer and www.sailing.ee  reserve the right to address the issue to the Consumer Protection Board or a court in order to protect their rights.<\/p>\n

9. Privacy policy<\/strong><\/h2>\n

9.1 By using the www.sailing.ee e-shop, you expressly and knowingly consent to Vivasailing Purjetamiskool O\u00dc processing your personal data under the terms and conditions set out in this contract.<\/p>\n

Your personal data entered for the purpose of making purchases are confidential information and not subject to disclosure to third parties, except as required by law and related parties for delivery purposes \u2013 Eesti Post, SmartPOST<\/p>\n

Vivasailing Purjetamiskool O\u00dc has the right to use your e-mail address also in its own economic activities for sending advertising and other information.<\/p>\n

Vivasailing Purjetamiskool O\u00dc is the controller of personal data who transmits the personal data necessary for making payments to the processor, Maksekeskus AS<\/p>\n

The security of the bank links used to pay for goods is ensured by an encrypted data communication channel where third parties do not have access to personal data and bank details.<\/p>\n

You can rest assured that our shopping environment is secure and that we will not transfer your data to third parties.<\/p>\n

10. Additional information<\/strong><\/h2>\n
